Terms of Service for Motivate

These Terms of Service (the “Terms”) govern your use of the Motivate iPhone application (the “App”), operated by Eunice Padua (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance

By using the App you confirm that you have read these Terms and our Privacy Policy (available in the App under Settings). If you use the App on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

Motivate is a daily quotes app. It includes a quote feed drawn from a public-domain library, reading themes, saved quotes, share cards, optional reminders, a private Journal, a daily reflection check-in, Home Screen and Lock Screen widgets, optional Sign in with Apple, an optional AI coach, and an optional Premium subscription.

Quotes, Journal entries, reflections, saved lists, and preferences are stored on your device unless a feature described in the Privacy Policy sends data off-device (iCloud Sync to your own Apple account, Sign in with Apple and account services, or the AI coach if you turn it on).

The Forum offers moderated posts and comments under your chosen profile username or an anonymous handle. It is the App’s only social feature.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. You must meet that age to use Sign in with Apple or the AI coach.

4. Accounts and Sign in with Apple

Sign in with Apple is optional. You may continue without an account and still use quotes, Journal, reflections, saved quotes, widgets, and reminders.

If you sign in, authentication is handled by Apple and our account authentication service. You are responsible for your Apple ID and for activity under your Motivate account.

You may delete your account at any time from Profile, as described in the Privacy Policy. Deletion removes server-side account data. It does not erase Journal entries or reflections stored on your devices or in your private iCloud.

5. Premium subscription, payments and renewals

Motivate is free to download and its core stays free: the daily quote feed, the For You and Favorites collections, the Graphite background, saved quotes, share cards, reminders from the Motivation collection, Journal, reflections and their 30-day history, widgets, Sign in with Apple, the Forum, Live Support, and one AI coach note per day.

Motivate Premium is an optional auto-renewable subscription. It adds the six remaining collections (Success, Happiness, Spirituality, Philosophy, Christianity and Islam), all 23 photographic themes, unlimited AI coach notes instead of one per day, reminders from any collection, and the alternate app icon. The purchase screen lists what you are buying, at what price and for what period, before you confirm.

Plans and price. Premium is offered as a monthly plan and an annual plan. The App Store shows the exact price in your currency, the billing period, and any introductory offer before you confirm the purchase. We may change list prices for future periods; the price of a period you have already paid for does not change.

Billing and automatic renewal. Payment is charged to the Apple Account you confirm the purchase with. Your subscription renews automatically for successive periods of the same length at the then-current price unless you cancel at least 24 hours before the end of the current period. Apple charges the renewal within 24 hours before that period ends. Apple is the merchant of record: it bills you, holds your payment details, and collects any applicable tax.

Cancellation. Cancel any time in iOS Settings → [your name] → Subscriptions, or in your App Store subscription settings; the App links there from Settings → Manage subscription. Cancelling stops future renewals and takes effect at the end of the period you have already paid for, and Premium stays active until then. There is no separate cancellation process with us, because we cannot cancel an App Store charge.

Refunds. Refunds are handled by Apple. Request one at reportaproblem.apple.com. If Apple refunds a charge, Premium access ends when Apple revokes the entitlement and those features return to the free tier.

Introductory offers and free trials. When the purchase screen shows a free trial or another introductory offer, you are charged only when it ends, at the price and period shown there, unless you cancel beforehand.

Restore. Premium follows your Apple Account. Use Restore on the purchase screen, or reinstall the App and sign in with the same Apple Account, to recover an active subscription. The App verifies access from Apple’s signed transaction data on your device, and our subscription infrastructure provider (RevenueCat) can confirm the subscription to us so Premium follows your account — we keep only that subscription status (never your payment details) and cannot restore access by looking up a purchase ourselves.

No other billing. Premium is sold only through the App Store. We do not process payments, do not receive your card number or billing address, and offer no other way to buy it.

6. User content

You may create Journal entries, reflections, notes, Forum nicknames, profile photos, posts and comments (“User Content”). You retain your rights in your User Content. You are responsible for it and for keeping any backup you need.

On-device User Content is yours to export or delete in the App. You can clear your Forum profile photo at any time from Settings. Forum posts and comments are subject to review and may be rejected or removed. Inappropriate nicknames may be replaced with a neutral display name, and inappropriate profile photos may be removed. Do not use nicknames or photos to harass others, spread hate, or share offensive or spam content. Forum User Content may be removed when you delete your account or if it violates these Terms.

7. AI coach — not professional advice

The optional AI coach generates motivational notes from check-ins you choose to share. It is for informational and motivational purposes only. It is not medical, mental-health, therapeutic, financial, legal, or other professional advice. Do not rely on it for diagnosis, treatment, crisis support, or any decision that requires a qualified professional. If you are in crisis, contact local emergency services or a qualified helpline.

We do not warrant that coach notes are accurate, complete, or appropriate for you.

The App’s design, code, photography themes, widgets, original writing (including original “Motivate” lines and greeting copy), and trademarks are owned by us or our licensors and are licensed to you for personal, non-commercial use on Apple-branded devices.

The quote library is limited to works believed to be in the public domain in the United States (including classical and other public-domain authors, traditional proverbs, and original lines written for the App). Public-domain status can depend on country and on later translations; the App is not a legal opinion that a given line is public domain everywhere. If you believe a quotation is included in error, email us and we will review it.

10. Privacy

Your use of the App is also governed by the in-app Privacy Policy, which describes on-device data, Sign in with Apple and account services, and the optional AI coach.

11. Consumer protections and accessibility

Nothing in these Terms excludes or limits consumer rights, statutory warranties, remedies, refund rights, or other protections that cannot lawfully be excluded or limited in your place of residence. Where local law provides a mandatory guarantee or cooling-off period, that law applies.

We aim to provide an accessible service and welcome reports of accessibility barriers through the Contact information below. You remain responsible for ensuring that use of the App is appropriate for your circumstances and device.

12. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any content (including quotes and coach notes) will be accurate or suitable for you.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App, even if advised of the possibility. Our total liability for any claim relating to the App or these Terms will not exceed the amount you paid us for the App in the twelve (12) months before the claim (if you have never bought a subscription, that amount is $0).

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.

14. Termination

You may stop using the App at any time and may delete your account as described above. We may suspend or end access if you violate these Terms or if the service is discontinued. Sections that should survive (including intellectual property, disclaimers, and limitation of liability) will survive.

15. Changes

We may update these Terms. The “Last Updated” date will change. The in-app Terms are the version that applies to the build you are using. Continued use after an update means you accept the revised Terms.

16. Export controls and sanctions

You may not use, export, re-export, or provide access to the App in violation of applicable export-control, sanctions, or trade laws. You represent that you are not located in, ordinarily resident in, or acting on behalf of a person or organization subject to applicable sanctions, except as permitted by law.

17. Governing law

These Terms are governed by the laws applicable in your country of residence, without depriving you of mandatory consumer protections. Disputes may be brought before the courts having jurisdiction under applicable law. Nothing here requires arbitration or waives a mandatory right to bring a claim before a competent court.
